1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Catch King Boat Club LLC ("Company," "we," "us," or "our") governing your membership and use of our boat club services in Corpus Christi, Texas. By becoming a member or using our services, you agree to be bound by these Terms.

2. Membership

2.1 Eligibility

Membership is available to individuals who are at least 21 years of age, possess a valid government-issued ID, and demonstrate adequate boating experience and knowledge. We reserve the right to refuse membership at our discretion.

2.2 Membership Fees

Members agree to pay an annual membership fee of $3,998, monthly dues of $398, and fuel charges of $5.50 per gallon used. Promotional discounts may apply and will be reflected in your membership agreement. Fees are subject to change with 30 days written notice. All fees are non-refundable unless otherwise specified.

2.3 Membership Duration

Membership begins upon approval and payment of initial fees and continues on a month-to-month basis after the initial term. Either party may terminate membership with written notice as specified in Section 8.

3. Boat Usage

3.1 Reservations

Members may reserve boats through their Member Portal. Members may have two active reservations on the books at a time, allowing you to plan ahead. Reservations can be booked a day in advance. Day trips are available from 6:00 AM to 5:00 PM, and night trips are available from 6:00 PM to 5:00 AM. Reservations are subject to availability.

3.2 Boat Operation

Members agree to operate boats safely and in compliance with all federal, state, and local laws. Members must not operate boats while under the influence of alcohol or drugs. Members are responsible for all persons aboard during their reservation.

3.3 Geographic Limitations

Boats are designated for intracoastal use only within a boundary set by Aransas Pass in the north to Bird Island in the south (mid-range Laguna Madre). This boundary encompasses over 300 square miles of fishing spots, including Corpus Christi Bay, the Upper Laguna Madre, and all bays in between. Offshore use is strictly prohibited.

4. Member Responsibilities

Members are responsible for:

• Following all club rules and regulations
• Reporting any damage, accidents, or incidents immediately
• Ensuring all guests comply with club rules
• Maintaining current contact information
• Timely payment of all fees and charges
• Proper care and respectful treatment of all club property

5. Damage and Liability

Members may be held financially responsible for damage to boats or equipment caused by negligence, misuse, or violation of these Terms or club rules. Members agree to the liability waiver as a condition of membership. SeaTow coverage is provided for emergency assistance but does not cover damage caused by member negligence.

6. Dockside Concierge Service

Our concierge service includes preparing boats before reservations (cleaning, fueling, ice) and handling boats after return. Members must return boats to designated locations and report any issues. Failure to properly return boats may result in additional charges.

7. Indemnification

You agree to indemnify and hold harmless Catch King Boat Club LLC, its officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of club boats, violation of these Terms, or negligent or wrongful conduct.

8. Termination

Either party may terminate membership with 30 days written notice. The Company reserves the right to immediately terminate membership for violation of these Terms, safety concerns, non-payment of fees, or conduct deemed detrimental to the club or other members. Upon termination, all access to club services ceases immediately.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CATCH KING BOAT CLUB LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR MEMBERSHIP OR USE OF OUR SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Nueces County, Texas.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated to members via email or through our website. Continued use of services after changes constitutes acceptance of modified Terms.
