Boating and water activities involve inherent risks, dangers, and hazards that cannot be eliminated regardless of the care taken to avoid them. These risks include, but are not limited to:

• Drowning or near-drowning
• Collision with other vessels, objects, or marine life
• Equipment failure or malfunction
• Adverse weather conditions including storms, high winds, and lightning
• Grounding, capsizing, or swamping
• Sun exposure, heat exhaustion, and dehydration
• Slips, trips, and falls on wet surfaces
• Injuries from fishing equipment and marine life
• Getting lost or stranded
• Mechanical failures

By participating in Catch King Boat Club activities, you acknowledge and accept these risks.

No Warranty

CATCH KING BOAT CLUB LLC PROVIDES BOATS AND SERVICES "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that boats will be free from defects, that services will be uninterrupted, or that any specific outcome will be achieved. While we maintain our fleet to high standards, equipment can fail without warning.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, CATCH KING BOAT CLUB LLC, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Personal injury or death
• Property damage or loss
• Loss of enjoyment or inconvenience
• Lost profits or business opportunities
• Emotional distress
• Any other damages arising from participation in club activities

This limitation applies regardless of whether the claim is based on warranty, contract, tort, negligence, strict liability, or any other legal theory.

Member Responsibility

Members are solely responsible for:

• Assessing their own skill level and physical ability to safely operate boats
• Checking weather conditions and making safe decisions about when to boat
• Operating boats in a safe and legal manner
• Ensuring all passengers have appropriate safety equipment
• Supervision of all guests and passengers
• Knowing and following all applicable boating laws and regulations
• Making safe navigation decisions

SeaTow Coverage

While all boats include SeaTow membership for emergency assistance, SeaTow coverage has limitations. SeaTow provides towing and assistance services but does not cover all situations or damages. Review SeaTow's terms of service for complete coverage details. Catch King Boat Club makes no guarantees regarding SeaTow response times or service availability.

Fishing Disclaimer

We make no guarantees regarding fishing success. Fish populations, weather conditions, and other factors affect fishing results. Maps and fishing spot information are provided as general guidance only and do not guarantee fishing success. Members are responsible for knowing and following all fishing regulations.

This disclaimer and any disputes arising from your participation in Catch King Boat Club activities shall be governed by the laws of the State of Texas. Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Nueces County, Texas.

Severability

If any provision of this disclaimer is found to be unenforceable or invalid, such provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions shall remain in full force and effect.
